These Terms of Service (“Terms”) govern your access to and use of the CommonSight property and construction management platform, including our website, web application, and related services (collectively, the “Service”), provided by CommonSight (“CommonSight,” “we,” “us,” or “our”). Please read them carefully.
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization. If you do not agree to these Terms, do not use the Service.
CommonSight is a unified platform that connects developers, builders, vendors, homeowners, and HOA management to manage new home approvals, lot and property data, projects, tasks, checklists, warranty claims, and related communications. Features and modules available to you depend on your account type, selected modules, and subscription tier.
Certain features of the Service are offered on a paid subscription basis. Pricing depends on your account type, modules, and tier, and any per-lot or per-property charges that apply. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law, and exclude applicable taxes. We may change our fees on reasonable notice; changes apply to the next billing cycle.
You agree not to:
You retain ownership of the content and data you submit to the Service (“User Content”). You grant us a limited, non-exclusive license to host, process, display, and transmit User Content solely to operate and provide the Service to you and your authorized collaborators. You are responsible for the accuracy, legality, and rights to your User Content.
The Service, including its software, design, text, graphics, and logos, is owned by CommonSight or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in the Service. You may not use our trademarks without prior written permission.
The Service may integrate with or rely on third-party services, such as hosting, authentication, and mapping providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, CommonSight and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the claim.
You agree to indemnify and hold harmless CommonSight and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a risk to the Service or others. Upon termination, your right to use the Service ceases, though provisions that by their nature should survive will continue to apply.
These Terms are governed by the laws of the jurisdiction in which CommonSight is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
